REGISTRATION OF TRADEMARKS IN IRAQ :
THE PROCEDURES AND ITS HONORARIUM
The subject of registration of commercial trademarks and data is governed by Act No. 21 for year 1957 “Commercial Trademarks and Data” whose latest amendment was by CPA Order No. 80 published in the Al-Waqai Al- Iraqiya (official gazette) No. 3983 on June 2004 (an amendment which was not implemented yet).
Hence the procedure for registration of Commercial Trademarks are as follows :
1- 1- Sending a color photo of the trademark for purpose of preliminary inspection.
2- 2- Payment of dues for the preliminary inspection and preliminary registration.
3- 3- In case non- existence of a similar trademark to the one to be registered upon conducting the preliminary inspection, the registration shall be published in the special bulletin and payment of dues thereof.
4- 4- Subsequent to payment of Final Acceptance dues, receipt of Commercial Trademark Registration Certificate shall be realized.
Total dues to be paid by an Arab or foreign COMPANY for completion of the fore- cited procedure is not in excess of (1 500) one thousand five hundred US dollars.
REQUIRED PREREQUISITES BY US FOR COMPLETION OF REGISTRATION
1- 1- color photo of the commercial trademark
2- 2- Power of attorney in the name of the person undertaking the registration (triple name of the lawyer from UNITED LAWYERS, LEGAL CONSULTANTS, ADVOCATES AND ACCOUNTING MANAGEMENT) issued by the principal COMPANY (the issue by the COMPANY’s representative COMPANY or one of its branch is barred) and signed by the COMPANY’s managing director or an authorized person for such. This power of attorney should be authenticated by the Notary Public, the principal COMPANY’s Foreign Ministry and the Iraqi Embassy in that country. If there were no Iraqi embassy in that country, then that of the nearest country of the principal COMPANY.
3- 3- Duration for registration completion shall not exceed 60 days, according to our latest contact with officials of the authorized body for registration .

The dues for payment :
1- 1- 300 000 dinars dues for registration application.
Added to it are dues for categories as following :
50 000 dinars dues for Category No. 1 - 3
30 000 dinars for Category No.4
20 000 dinars for Category No.5 and above.
Note 1
Total dues shall not exceed 500 000 dinars.
Publication dues: Fixed amount of 300 000 dinars.
2- 2- Dues for Registration certificate:
Fixed amount of 150 000 dinars, added to it the same dues for Categories Registration (which shall not be in excess of 500 000 dinars)

قد عينَا الوكيل المحامي ****** وكيلا حقيقيا وقانونيا ليطلب ويحصل على تسجيل العلامات التجارية وبراءات الاخراع والنماذج الصناعية العائدة لنا في العراق وعلى تجديد وتعديل ونقل ملكية وتسجيل حق استعمال وشطب والغاء العلامات التجارية وبراءات الاختراع والنماذج الصناعية المسجلة وقد فوضناه للغرض المذكور حق توقيع وتقديم كافة العرائض والوثائق والاعتراضات التي قد تكون ضرورية لذلك وتغييرها وتعديلها وله ان يوقع الدعوى او الدعاوي لدى الدوائر والمحاكم واية سلطة اخرى سواء مدنية كانت او جزائية وتقديمها والدخول فيها وتركها والدفاع عنها والاعتراض عليها والادعاء والتقابل بشأنها والمصالحة عليها وتعديلها وفصلها وعلى طلب التحكيم في اي اجزاء او دعوى او ادعاء او نزاع اخر يخص موضوع هذه الوكالة إلى اخر درجة وله تنفيذ الحكم او الاحكام المستحصلة وقبض مبالغها وتعقيبها إلى اخر درجة وله ان يعين اي وكيل او وكلاء وعزلهم واعطائهم الحقوق والصلاحيات التي يراها وله بصورة عامة ان يقوم بأي عمل قانوني يراه ضروريا او معجلا في تنفيذ هذه الوكالة. |

Do hereby appoint, Adv. ******* of Baghdad, Iraq as my/ our true and lawful agent to apply for and obtain registration of my/our trade marks. Patents and designs in Iraq, to renew, amend, assign, register licenses, cancel our registered trade marks, patents and designs and for the purpose aforesaid to sign, lodge applications, objections and all other documents which may be considered necessary, to alter and amend such documents; and then to lodge complaints with the offices, courts and any other authorities in any civil and penal proceeding : to attend to the execution of sentences obtained and receive money to the lat stage; to appoint any substitute and revoke such appointment and to give the substitute or substitutes so appointed such powers as may be necessary or as the said agent shall consider desirable in his discretion and generally to do any lawful thing which my / our said agent shall consider necessary or expedient for fully and effectually carrying out the purpose of the power of attorney. |
